1. An Applicant being Individual should have completed minimum 18 years of age to become a Distributor. He must furnish a certified copy of identity proof and address proof at the time of application.

2. To become a Distributor of the Company, the Applicant need to sign up online on the Company website at free of cost and may start purchasing packages to utilize the service of the company.

3. The Company may approve the applicant for Independent Distributorship by online and intimate by SMS / email, with a user ID & password as chosen automatically. This ID has to be quoted by the Distributor in all transactions and correspondence with the Company. The ID once created will not be altered later at any point of time. The Company under no circumstances will entertain any communication without ID.

4. The Company reserves the right to reject any distributorship application at its own discretion, if it finds not applicable.

5. The business opportunity is offered by the Company with the motto of promoting the services of the Company and establishment of the Company business in the market. With a view to achieve this, allocation of provisions from sales revenue to pay all the incentives within the same provision and in the event of insufficiency of provision, the company reserves the right to simulate/trim the benefits to meet within the provision. The decision of the Company in this regard shall be final and binding on all parties

6. There will be cooling off period of 15 days from the date of registration during which the distributor has got the right to rescind the contract for any reasons whatsoever by surrendering the Distributors I’D from the company. But shall take back the goods and rescind the contract provided the surrendered goods are of marketable quality.

7. In the event that the consumer unwilling to travel the services opted, the same can be claimed for refund through the travel package within 15 days from the date of purchase and the company shall refund the value paid by the distributor/consumer provided the consumer/ distributor proves that he has not utilised the service bought from the company with the deduction of Surcharges.

8. While Purchasing the Travel packages available with the company, the Distributor will have to pay the price of the package, by way of crossed demand drafts, pay order, NEFT/ RTGS in favour of Avere Voyage OPC Private Limited.

9. The Company has not authorized any official, officer or distributor of the Company to receive any amount in cash on behalf of the company towards the distributorship (ID Activation) fee, or price of package. Despite this, if anyone makes any payment in cash or claims to have made any cash payment to any company official, it will be at his/her own risk and under no circumstances, the company will not be liable for such unauthorized cash payments. 10. On payment for the package by the Distributor, the Company will not entertain any request for any change in package.

11. The Distributor is eligible for facilitation fees or income depending on the volume of business made by the Distributor and the eligibility norms formulated by the company from time to time. The Company does not assure any facilitation fees or income to the Distributor on the mere signing with the company as a Distributor.

12. The facilitation Incentives to the Distributor may be released by the Company after deduction of trimming fees, simulation charges, processing charges, Tax Deducted at Source (TDS), etc. The TDS will be deducted at the rate applicable from time to time. In the event of non-registration of PAN details with the Company, the Company reserves its right to block the ID and/or keep in abeyance such dues of the Distributor.

13. The Applicant/Distributor shall ensure that information furnished to the Company is correct and properly entered. Any request for correction furnished by the Distributor as to his/her sponsor or placement details will not be entertained after payment statements are processed.

14. The Distributors neither an agent nor employee of the Company and hence the Distributor cannot bind the Company. The Distributor has no authority in any manner to bind the Company nor to represent on behalf of the Company.

15. The Distributor shall bear true loyalty and allegiance to the Company and shall uphold the integrity and decorum of the Company always and shall maintain good relations with other Distributors and other clients.

16. The Distributor shall always behave and act in dignified manner befitting the status of Distributor of a reputed and leading marketing Company of the country.

17. The Distributor shall not compel or induce or mislead any person with any false statement/promise to sign up with the company or to purchase any package.

18. After completion of package period of 0ne year, if the services mentioned in the package is not availed by the distributor he shall not extend it and also if the distributor is inactive for more than 3 months in-between the term he/she shall be deemed to be discontinued as a distributor of the company unless or untill if he wishes to continue as a distributor taking a new package in the company as per the norms and stipulated price as on that date. And also services is upon the said package.

19. The Distributor shall go through the official website and the brochures and notices issued by the Company from time to time and make promises with the clients accordingly. The Company shall not be liable for any statement, promise or assurance given by any Distributor to any person, if such statement, promise or assurance is not in accordance with the approved business plan and terms of the Company as provided in the site.

20. All Distributors shall adhere to Rules & Regulations of the Company and if any Distributor is found guilty of not observing the same, the Company reserves its right to terminate the Distributor from the Company. The Company also reserves its right to terminate a Distributor, without assigning any reason or notice. Promise or assurance is not in accordance with the approved business plan and terms of the Company as provided in the site.

21. Every Distributor is entitled to terminate this Agreement by giving not less than 15 days' notice in writing to the Company and on receipt of such notice, the Company will deactivate the Distributor ID and there are no dues owed to the Company by the Distributor.

22. Once a Distributor is terminated, such person cannot market, sell, distribute, advertise, and propagandize, etc., the services of the Company. Such terminated Distributor shall not communicate or talk to the clients of the Company without permission from any of the Directors of the Company. The Company reserves its right to withhold the balance due payable to such terminated Distributor in the event of the Distributor infringing this clause.

23. Where the services of any Distributor are terminated on any account, either at the instance of the Distributor or at the instance of the Company, such person shall maintain complete secrecy of the various information and clients of the Company for a period of 5 years from the date of termination. Such Distributor is completely prohibited from contacting the clients of our Company or disclosing such confidential information to any person for any reason whatsoever and if found infringing this clause, it will be presumed that such person has infringed this clause for procuring business for the competitor of our Company. Moreover, such terminated Distributors should refrain from making slanderous or libellous remarks to any person either on the Company or its directors or our products whether to procure sales of other companies or not. This clause shall be surviving for a period of 5 years from the date of termination.

24. Trips are confirmed only on the basis of details furnished to the company before 25 Days of trip date. Once confirmed no Replacement or Cancellation can be done for the same.

25. The terms and conditions within above mentioned shall be governed in accordance with the Law in force asper ministry of consumer affairs. Disputes, if any, arising out of these terms, shall be subject to the exclusive jurisdiction of the Courts of Salem, Tamilnadu

26. If any dispute or difference arises between the parties hereto touching the business or interpretation of any or more of the terms and conditions of this Agreement, whether having any financial impact or not, the same shall be referred to arbitration as per the provisions of the Arbitration And Conciliation Act, 1996.

APPLICABILITY OF THE AGREEMENT:

This agreement (“user agreement”) incorporates the terms and conditions for Avere Voyage OPC Private Limited to provide service to the person (s) (“the User”) intending to purchase or inquiring for any products and / or services of Avere Voyage OPC Private Limited . by using Avere Voyage OPC Private Limited . Websites or using any other customer interface channels of Avere Voyage OPC Private Limited. which includes its sales persons, offices, call centres, advertisements, information campaigns etc. Both User and Avere Voyage OPC Private Limited. are individually referred as ‘party’ to the agreement and collective referred to as ‘parties’.

User’s Responsibility of Cognizance of this Agreement

Additionally, the service provider itself may provide terms and guidelines that govern particular feathers, offers or the operating rules and policies applicable to each service (for example, flights, hotel reservations, packages, etc.). The user shall be responsible for ensuring compliance with the terms and guidelines or operating rules and policies of the service provider with whom the user elects to deal, including terms and conditions set forth in a service providers’ fare rules, contract of carriage or other rules

Avere Voyage OPC Private Limited. Services are offered to the user conditioned on acceptance without modification of all the terms, conditions and notices contained in this Agreement and the TOS, as may be applicable from time to time. For the removal of doubts, it is clarified that availing of the services by the user constitutes an acknowledgment and acceptance by the user of this Agreement and the TOS. If the user does not agree with any part of such terms, conditions and notices, the user must not avail Avere Voyage OPC Private Limited. services. In the event that any of the terms, conditions, and notices contained herein conflict with the additional terms or other terms and guidelines contained within any other Avere Voyage OPC Private Limited. document, then these terms shall control.

Third Party Account Information

The user shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the services. In case, there is a short charging by Avere Voyage OPC Private Limited. for listing, services or transaction fee or any other fee or service because of any technical or other reason, it reserves the right to deduct/charge/claim the balance subsequent to the transaction at its own discretion.

In the rare possibilities of the reservation not getting confirmed for any reason whatsoever, we will process the refund and intimate you of the same, Avere Voyage OPC Private Limited. is not under any obligation to make another booking in lieu of or to compensate / replace the unconfirmed one. All subsequent further booking will be treated as new transactions with no reference to the earlier unconfirmed reservation.

For any refunds against the unutilized or ‘no show’ air or hotel booking for any reasons within 15 days of departure for the air thicket and / or the date of check in for the hotel booking. Any applicable refunds would according be processed as per the defined policies of Airlines, hotels and Avere Voyage OPC Private Limited. as the case may be. No refund would be payable for any requests made after the expiry of 15 days as above and all unclaimed amounts for such unutilized or no show air or hotel booking shall be deemed to have been forfeited. Any information which is specifically mentioned by Avere Voyage OPC Private Limited. as confidential shall be maintained confidentially by the user and shall not be disclosed unless as required by law or to serve the purpose of this agreement and the obligations of both the parties therein.

Usage of the Mobile Number of the User by Avere Voyage OPC Private Limited.
Avere Voyage OPC Private Limited. May send booking confirmation, itinerary information, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction, via SMS or by voice call on the contact number given by the user at the time of booking, Avere Voyage OPC Private Limited. may also contact the user by voice call, SMS or email in case the user couldn’t or hasn’t concluded the booking, for any reason what so ever, to know the preference of the user for concluding the booking and also to help the user for the same. The user hereby unconditionally consents that such communication via SMS and / or voice call by Avere Voyage OPC Private Limited. is

a) Upon the request and authorization of the user,
b) ‘Transactional’ and not an ‘unsolicited commercial communication’ as per the guidelines of telecom regulation authority of India (TRAI) and
c) In compliance with the relevant guidelines of TRAI or such other authority in India and abroad. The user will indemnify Avere Voyage OPC Private Limited. Against all types all types of losses and damages incurred by Avere Voyage OPC Private Limited. Due to any action taken by TRAI, Access Providers (as per TRAI regulations) or any other authority due to any erroneous compliant raised by the user on Avere Voyage OPC Private Limited. with respect to the intimations mentioned above or due to a wrong number or email id being provided by the user for any reason whatsoever.

Onus of the User

Will not be responsible for screening, censoring or otherwise controlling transactions, including whether the transaction is legal and valid as per the laws of the land of Avere Voyage OPC Private Limited. The user unequivocally indemnifies Avere Voyage OPC Private Limited. Of any such claim or liability and shall hold Avere Voyage OPC Private Limited. Responsible for any loss or damage arising out of measures taken by Avere Voyage OPC Private Limited. for safeguarding its own interest and that of its genuine customers.
